　　律師稱，從前有的案子可以上訴，但今年被拒絕的案子幾乎都毫無理由，退回的案子許多是移民局認(rèn)為“所申請(qǐng)的職位不是公司必要的”，這讓案子很難上訴，無法去反駁移民局。按照聯(lián)邦法律，移民官有自主裁決權(quán)，許多案子上訴也沒有好理由。這兩年H-1B補(bǔ)件比例比較高，尤其是學(xué)商和學(xué)文的。
　　華通夏令營老師指出，移民官要從幾個(gè)方面審核申請(qǐng)，其中一個(gè)就是要問這個(gè)公司需不需要你的專長。最近幾年商科畢業(yè)生比較多，這種商科專業(yè)可以在很多地方工作，他們可以在各種行業(yè)工作，有點(diǎn)像“萬金油”，所以移民局會(huì)有疑問，這樣審批難度就會(huì)加大。
　　律師還舉例說，從前有很多申請(qǐng)市場調(diào)查的案子都被通過了，但是現(xiàn)在這種案子特別容易被要求補(bǔ)件，如移民官會(huì)問申請(qǐng)人的公司有做了哪些市場調(diào)查服務(wù)，并要公司出示市場調(diào)查成員的具體分工細(xì)節(jié)。
